Assumption of Risk, Release of Liability, Media Release, and Florida Agritourism Notice

By purchasing tickets, making a reservation, entering Amber Brooke Farms ("Amber Brooke Farms," the "Farm," "we," "our," or "us"), or participating in any activity at the Farm, you acknowledge that you have read, understand, and voluntarily agree to the following terms.

If you purchase tickets for additional guests, you acknowledge that you are responsible for providing these Terms and Conditions to each member of your party. By completing your purchase, you represent and warrant that:

• You are at least eighteen (18) years of age.
• You have the legal authority to accept these Terms on behalf of yourself.
• If you are purchasing tickets for a minor child or children for whom you are the parent or legal guardian, you have the legal authority to accept these Terms on their behalf.

You understand that each adult guest is responsible for accepting these Terms for themselves, and you agree to inform all members of your party of these Terms before visiting the Farm.

Amber Brooke Farms is a working agricultural operation and agritourism destination. Visiting a farm and participating in agritourism activities involves inherent and unavoidable risks that cannot be eliminated without fundamentally changing the nature of the experience.

Activities Include, But Are Not Limited To:

• U-pick fruit and produce;
• Walking through fields, orchards, and agricultural areas;
• Playgrounds, slides, jump pillows, pedal carts, corn pits, hay mazes, and climbing structures;
• Animal encounters, petting areas, and animal feeding;
• Tractor rides, wagon rides, and other transportation around the Farm;
• Festivals, birthday parties, school groups, educational programs, and seasonal attractions;
• Food and beverage areas, retail areas, parking lots, restrooms, and all other Farm facilities.

You knowingly and voluntarily assume all known and unknown risks associated with entering the Farm and participating in these activities, including, but not limited to:

• Uneven, muddy, wet, slippery, rocky, or changing terrain;
• Holes, roots, gravel, ditches, standing water, and natural obstacles;
• Tractors, trailers, utility vehicles, machinery, irrigation equipment, fences, gates, and moving equipment;
• Livestock, domestic animals, wildlife, and unpredictable animal behavior, including bites, kicks, scratches, pecking, trampling, or other contact;
• Bees, wasps, fire ants, spiders, snakes, insects, and other wildlife;
• Dust, pollen, hay, plants, berries, food products, chemicals, smoke, and other allergens;
• Heat, humidity, sun exposure, lightning, rain, wind, severe weather, and other environmental conditions;
• Slips, trips, falls, collisions, equipment failure, physical exertion, and accidents;
• The acts or omissions of other guests;
• Your own actions or negligence or those of members of your party.

You understand these risks may result in bodily injury, illness, allergic reactions, emotional distress, permanent disability, property damage, or death. Participation is entirely voluntary, and you are solely responsible for determining whether you and any minor child under your supervision are physically able to participate safely.

By purchasing tickets and entering Amber Brooke Farms, you represent that you and any minor child for whom you are the parent or legal guardian are physically able to participate in Farm activities.

You understand that participation may involve exposure to animals, hay, pollen, dust, insects, weather, food products, and other agricultural or environmental conditions that may cause allergic reactions, illness, or injury. You voluntarily assume all risks associated with such exposure.

Amber Brooke Farms does not provide medical care or supervision. In the event of an accident or medical emergency, you authorize Amber Brooke Farms to contact emergency medical services if deemed necessary. You acknowledge that you are solely responsible for any medical expenses incurred by you or any member of your party.

If any provision of these Terms and Conditions, including the Assumption of Risk, Release of Liability, Media Release, or any other provision, is determined by a court of competent jurisdiction to be invalid, illegal, unenforceable, or otherwise ineffective, such determination shall not affect the validity or enforceability of the remaining provisions.

The remaining provisions shall continue in full force and effect and shall be construed so as to carry out the original intent of the parties to the fullest extent permitted by law.

If any portion of the Release of Liability is found unenforceable as to a particular claim or circumstance, all other portions shall remain fully enforceable to the maximum extent permitted under applicable law.

To the fullest extent permitted by Florida law, you, on behalf of yourself and any minor child for whom you are the parent or legal guardian, voluntarily release, waive, discharge, and covenant not to sue Amber Brooke Farms and its owners, members, managers, officers, directors, employees, volunteers, agents, contractors, affiliates, insurers, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, causes of action, liabilities, damages, losses, judgments, costs, expenses, or attorneys' fees arising out of or relating to your presence on the Farm or participation in any Farm activity, including claims arising from the ordinary negligence of the Released Parties.

This Release does not apply to claims arising from gross negligence, reckless conduct, or intentional misconduct to the extent such claims cannot legally be waived under Florida law.

By entering Amber Brooke Farms, you grant Amber Brooke Farms and its authorized representatives permission to photograph, film, videotape, livestream, or otherwise record you and any minor child accompanying you.

You authorize Amber Brooke Farms to use these photographs, videos, recordings, or likenesses for advertising, marketing, promotional, educational, public relations, website, social media, and other commercial or non-commercial purposes in any media now known or later developed, without compensation, further approval, or additional notice.

If you do not wish to appear in promotional materials, you may notify Guest Services before entering the Farm. Amber Brooke Farms will make reasonable efforts to honor such requests; however, incidental inclusion in crowd scenes or public areas cannot be guaranteed.

If the participant is under 18 years of age, this section MUST be completed by the participant's parent or legal guardian. By signing below, the parent or legal guardian represents that they have the legal authority to execute this Agreement on behalf of the minor participant.

I, the undersigned parent or legal guardian of the minor participant named above, have read and fully understand this Agreement. I hereby consent to the minor's participation in the Activity and agree, on behalf of myself and the minor, to all terms and conditions set forth in this Agreement, including the Assumption of Risk, Release of Liability, Indemnification, and Media Release provisions. I acknowledge that I am waiving legal rights that the minor may otherwise have.
